Mediación Intercultural en el Ecuador

Abstract

Abstract: Mediation in our country has been in force since 1997 through the Law of Arbitration and Mediation, in this work an analysis is made of the current situation of this conflict resolution tool applicable not only within the judicial field but also within the social sphere. Our country recognized by the Magna Carta of 2008 as an Intercultural State, recognizes the existence and relationship between ethnoculturally differentiated citizens, so through Intercultural Mediation, a modality of mediation, it seeks to establish a negotiation relationship (social, political and cultural) from which new strategies, expressions, meanings and practices must emerge that challenge the prevalence of one culture over the other. Through the intervention of third parties, in and on social situations of significant multiculturalism, the recognition of the Other and the rapprochement of the parties, communication and mutual understanding, the learning and development of coexistence, the regulation of conflicts and institutional adaptation, between ethnoculturally differentiated social or institutional actors.
