Abstract: The inconvenience in the valuation of the property to be expropriated, has been a problem for the Ecuadorian state and for the owner of the expropriated property, the same is taken for reasons of public utility or social interest and national level as a way to expand a school , a health center and any work of social interest, as there is no agreement in the administrative process is the condemnation where your goal is only to determine the price of the goods, the survey produced the valuation of goods is done with the rateable value and then in the sentence pronounced by the judge the value is the market value being a lower value, that ultimately comes to harm the owner of the property. And then the expropriation payment delay what is new is another owner's ordeal. All this creates damage to the owner's property the same as is guaranteed in the Constitution of the Republic.
Description: La inconveniencia en la valoración de los bienes a expropiarse, ha constituido un problema para el Estado ecuatoriano y para el propietario del bien expropiado, la misma se da por razones de utilidad pública o interés social y nacional, como para ampliar una vía, una escuela, un centro de salud y cualquier obra de interés social; al no existir acuerdo en el trámite administrativo viene el juicio de expropiación donde su objetivo es únicamente determinar el precio del bien; al producirse el peritaje de valuación de los bienes se la realiza con el valor catastral y luego en la sentencia pronunciada por el juez el valor no es el valor de mercado siendo un valor inferior, que a la final viene a perjudicar al propietario del bien. Y luego el pago de la expropiación demora por lo que es otro vía crucis del propietario. Todo esto configura un daño en la propiedad del dueño la misma que está garantizada en la Constitución de la República.
