Abstract: The present research work aims to analyze recursive forms and support in our procedural design, at the stage of execution of civil judgements specifically on the Executive, a resource that is applicable to the violation of substantial solemnities, significantly changing the structure of the Executive lawsuits in its stage of implementation in the code of Civil procedure. The conclusions that this project are developed on the basis of the application of the principles of efficiency, legal certainty, justice, due process, free use of Justice, means of administration of Justice, procedural haste, effective judicial protection of rights, the principle of good faith and procedural loyalty. This legal research work consists of history, where substantially summarizes the history, concepts and context of the applicability of the present topic. The analysis of the incidence and its feasibility was born of the need for a form of resource enabling the effective defense of rights when there is clear violation of these. The verification of the results is them using methods of legal research: survey, observation and consultation of experts.
Description: El presente trabajo de investigación tiene como objetivo analizar las formas recursivas y admitir en nuestro diseño procesal, en la etapa de ejecución de los juicios civiles específicamente en el ejecutivo, un recurso aplicable a la violación de solemnidades sustanciales, cambiando notablemente la estructura de los juicios ejecutivos en su etapa de ejecución en el Código de Procedimiento Civil. Las conclusiones que tiene este proyecto son desarrolladas en base a la aplicación de los principios de eficacia, seguridad jurídica, justicia, debido proceso, gratuidad de la justicia, sistema medio de administración de justicia, celeridad procesal, tutela judicial efectiva de los derechos, principio de buena fe y lealtad procesal. El presente trabajo de investigación jurídica se compone de antecedentes, donde se resume sustancialmente la historia, conceptos y contexto de la aplicabilidad del presente tema.
