dc.description	En la presente tesis, se realizó un trabajo investigativo sobre el marco teórico y doctrinario referente a la manifiesta negligencia y/o error inexcusable, la normativa vigente para el ejercicio de la potestad disciplinaria por parte del Consejo de la Judicatura, en los casos en los cuales los jueces de la materia civil, incurren en estas infracciones disciplinarias tipificadas y sancionadas en el numeral 7 del artículo 109 del Código Orgánico de la Función Judicial, para lo cual se efectúo un análisis de los criterios utilizados por el Consejo referido, al calificar la manifiesta negligencia y/o error inexcusable en contra de los operadores de justicia de la materia antes referida. Asimismo, se investigó lo referente a las modulaciones que realiza el Consejo de la Judicatura, en casos especiales, en los cuales ha declarado la responsabilidad de incurrir en manifiesta negligencia y/o error inexcusable, empero, en base a las circunstancias del hecho y en atención al numeral 14 del artículo 264 del C.O.F.J., modulan las sanciones impuestas y en lugar de sancionar con una infracción gravísima, sancionan con una grave o leve.	es_ES
dc.description.abstract	In this thesis, a research work on the theoretical and doctrinal framework concerning gross negligence and / or inexcusable error was made, the rules governing the exercise of disciplinary powers by the Judicial Council, in cases which judges in civil matters, engage in such disciplinary offenses defined and sanctioned in paragraph 7 of Article 109 of the Code of Judicial Function, for which an analysis of the criteria used by the said Council was held, calling the gross negligence and / or inexcusable error against justice operators of matter referred to above. Also, regarding the modulations made by the Judicial Council, in special cases, which it has declared the responsibility of incurring gross negligence and / or inexcusable error, however investigated, based on the circumstances of fact and attention to paragraph 14 of Article 264 of COFJ modulate sanctions and instead of penalizing a serious offense, punishable by a severe or mild.	es_ES
