| Abstract: | Upon completion of this work and after the research I consider to know what is the extraordinary action of protection in Ecuador's legal sphere is of fundamental importance to any lawyer who is in the free practice this because this action It allows revisiting the firm or final judgment and if any violations of the rights guaranteed in the Constitution, during the process in which the judge acts as the guarantor has violated resolutions are rectified immediately. This research has made in order to get to know what the function of the extraordinary action of protection in Ecuadorian law, in the same way to determine the objectives of the same, taking into account which also is the role of judge in the process of trial and as guarantor of the rights of citizens, all this also contrasted with interviews with lawyers on this issue as well as constitutional judgments on the subject have solved this research action |
| Description: | Al finalizar este trabajo y luego de la investigación realizada considero que conocer sobre lo que es la acción extraordinaria de protección, en el ámbito legal ecuatoriano es de fundamental importancia para todo abogado que se encuentra en el libre ejercicio profesional, esto debido a que esta acción permite volver a revisar la sentencia o resoluciones definitivas en firme y en caso de existir violaciones a los derechos garantizados en la Carta Magna, durante el proceso en el que el juez que actúa en calidad de garante los ha vulnerado sean rectificados inmediatamente. La presente investigación se la ha realizado con el fin de lograr conocer cuál es la función de la acción extraordinaria de protección en la legislación ecuatoriana, de la misma forma poder determinar los objetivos de la misma, tomando en cuenta también cual es la función del juez dentro del proceso de juzgamiento y su calidad de garante de los derechos de los ciudadanos, todo esto también contrastado con entrevistas realizadas a profesionales del derecho acerca de este tema así como también a sentencias constitucionales que han resuelto sobre la acción materia de esta investigación |
