Abstract: Throughout history, the victim of crime has been concealed by a system of justice focused primarily on crime, relegating the victim to be a witness more of the criminal act, There remains a subject, who silently suffers a cause of the crime, whose pain is not satisfied with a sentence depriving the offender of freedom, so it is necessary to go beyond and watch for its recovery through integral reparation. This thesis includes a legal and victimological study on the victim of rape, in order to understand the delicate position that the victim has against the crime; The Constitution in force since 2008, recognizes as a right to the victim of criminal offenses the integral reparation, the same makes the new Organic Comprehensive Criminal Code, in force since 2014; However, so this research is focused on analyzing what the right to integral reparation understands and how this right is enforced by the victim. The crime of rape is possibly one of the most serious, as it directly attacks a fundamental right such as personal integrity, which is why the person who is the victim of this crime, during the criminal process to punish the offender, must be Assisted; And it is the State that must ensure that this is fulfilled.
Description: A lo largo de la historia, la víctima del delito ha sido ocultada por un sistema de justicia enfocado principalmente, en el criminal, relegando a la víctima a ser un testigo más del acto delictivo; queda entonces, un sujeto, que sufre silenciosamente a causa del delito, cuyo dolor no se sacia con una condena privativa de libertad al delincuente, por lo que es necesario ir más allá y velar por su recuperación a través de la reparación integral. La presente tesis comprende un estudio jurídico y victimológico sobre la víctima de violación sexual, con el fin de comprender la delicada posición que tiene la víctima frente al hecho delictivo; la Constitución vigente desde el año 2008, reconoce como derecho a la víctima de infracciones penales la reparación integral, lo propio hace el nuevo Código Orgánico Integral Penal, vigente desde el año 2014; sin embargo, por lo que esta investigación está enfocada en analizar qué comprende el derecho a la reparación integral y cómo se llega a hacer efectivo este derecho por parte de la víctima. El delito de violación es posiblemente uno de los más graves, pues ataca de manera directa a un derecho fundamental como es la integridad personal, motivo por el cual, la persona víctima de este delito, durante el proceso penal para sancionar al delincuente, debe ser asistida y se debe buscar que bajo ningún concepto sea revictimizada; y, es el Estado quien debe velar para que esto se cumpla
