Abstract: In the present work of investigation is realized an analysis starting from doctrinal criteria on the indemnifications that are demanded to the repair of the affectation to the honor and the good name before the commission of criminal facts, for this a theoretical and practical study of The elements involved in this process; As well as evaluating the current legal regulations on the subject in the country. In Ecuador, civil lawsuits have been filed for millions of damages, for the honor offended, for moral damages or other damages caused, which are disproportionate and therefore not fair and objective to their requirements, being necessary to reform the Comprehensive Criminal Organic Code to Establish an amount that serves as a limit to the judges to admit and decide this type of claim and thus prevent the abuse that these high economic damages produce in order to ensure that the legal provisions that are applied objectively resolve conflicts and This form materialize the principle of legal security of citizens.
Description: En el presente trabajo de investigación se realiza un análisis partiendo de criterios doctrinales acerca de las indemnizaciones que se demandan a la reparación de la afectación al honor y el buen nombre ante la comisión de hechos delictivos, para ello se realiza un estudio teórico y práctico de los elementos que intervienen en este proceso; así como se valora la normativa legal vigente sobre el tema en el país. En el Ecuador se han establecido demandas civiles por indemnizaciones millonarias, por el honor ofendido, por daño moral u otros perjuicios causados, las que resultan desproporcionadas y por tanto no son justas y objetivas a sus requerimientos, siendo necesario reformar el Código Orgánico Integral Penal para establecer un monto que sirva de limite a los jueces para admitir y decidir este tipo de demanda y de esta forma impedir al abuso que producen estas altas indemnizaciones económicas para con ello garantizar que las disposiciones legales que se apliquen resuelvan de manera objetiva los conflictos y de esta forma materializar el principio de seguridad jurídica de los ciudadanos.
