Restitución internacional de Menores en la Legislación Ecuatoriana

Abstract

The following thesis title is International Restitution of Children in Ecuadorian Legislation, the objective is to analyze the juridic vacuums that exist in doctrine, legislation and process about International Restitution of Children, in relation with international conventions about Children Restitution comparing with legal order in Ecuador, in consideration of the multiple doctrines, principles and postulates mentioned in Children Law not just national but international standard, also conducting surveys to several judicial officers in Quito city, and analyze court judgements about this topic. IN this thesis had been used research methods approved in social and judicial sciences. After this thesis has been developed the results shows that The Hague Convention of 1980 about Civil Aspects of Children subtraction, as Interamerican Convention and Children Laws Convention, are not contradictory to ecuadorian constitutional regulation, and show the complete absence of Children Restitution in ecuadorian legislation
