Las sanciones penales como garantía de los derechos fundamentales en la justicia indígena de la provincia de Orellana

Abstract

This paper offers a comparative study on the penal sanctions imposed on the indigenous people of the province of Orellana, when these are prosecuted for a criminal offense. Through the investigation will be obtained results that allow to know the serious violations to the fundamental rights to which the indigenous are subject, by virtue of justice is this ordinary or indigenous. In addition it allows to know how to do justice according to the indigenous worldview, which consists in charging revenge by means of violent confrontations in order to torture and kill the enemy. At the same time, the relevance of preventive detention will be analyzed, since they are people who live in their vast majority as nomads who have never been deprived of their liberty in their lives, and the damage caused by imprisonment in their lives
