| Abstract: | The present research is an academic major contribution about “The Theory of the Case in embezzlement by appropriation”; It exposes and explains necessary concepts for its development and support, either from the role of the prosecutor fiscal or defense counsel, both of which when exposed to a judge or court of justice should be consistent with the legal doctrine and the facts investigated, therefore an analysis on the Theory of the Case and the Theory of Crime has been provided to this investigation. |
