Abstract: Ecuador being a constitutional State of rights and justice, the present research work failed to find the failures at the time of application of the principle of objectivity on the part of prosecutors, resulting in violation of rights of the investigated and prosecuted and therefore distrust the administration of justice. A review of the principle of objectivity in the Ecuadorian law and comparative law and lack of application, which forms part of the criminal investigation, subject to the basic guarantees of due process, determining the role of the prosecutor in the framework of its powers was made law, where the research was conducted in the city of Puerto Baquerizo Moreno, San Cristobal canton province of Galapagos. In this paper concludes that while it is true the principle of objectivity, aims at guaranteeing basic rights of the accused in criminal matters, lack of implementation brings rights violations, thus making it necessary to implement control mechanisms to prosecutors comply with this legal principle.
Description: Siendo el Ecuador un Estado constitucional de derechos y justicia, el presente trabajo investigativo logró encontrar las falencias al momento de la aplicación del principio de objetividad por parte de los fiscales, lo que genera vulneración de derechos de los investigados y procesados y por ende desconfianza en la administración de justicia. Se realizó una reseña sobre el principio de Objetividad en la legislación ecuatoriana y legislación comparada y su falta de aplicación, enmarcado dentro de la investigación penal, con sujeción a las garantías básicas del debido proceso, determinando el rol del fiscal en el marco de sus facultades legales, el lugar donde se realizó la investigación fue en la ciudad de Puerto Baquerizo Moreno, cantón San Cristóbal, provincia de Galápagos. Con el presente trabajo se concluye, que si bien es cierto el principio de objetividad, está orientado a garantizar los derechos básicos del procesado en materia penal, su falta de aplicación ocasiona vulneración de derechos, por lo que resulta necesario implementar mecanismos de control para que los fiscales cumplan con este principio jurídico.
