Abstract: The present investigation, with the theme: The law of defense and the investigation, reflects, that any person detained in (flagrante delicto) or by order of judicial authority (initiated a process), on an alleged crime that is imputed to him, To demand respect for their right to liberty and to make the principle of innocence prevail, enshrined in the Constitution of the Republic and in the International Human Rights Treaties, requires the sponsorship of a legal professional (Lawyer) to carry out their Technical defense during the development of the process, and may be this private and lack of that, public. The defense of the private lawyer, is more reliable than the public, because this professional, devotes 100% of his time to the case, doing everything possible to get the ratification of the state of innocence of his client and if he can not There are indications that involve him, he will try to obtain the minimum penalty and the exemption of the fine considering the economic situation of his family, presenting justifications and the resources that the law allows him. In contrast the defense sponsored by the Public Defender, is limited, by its time, has many causes in its charge, since the majority of the processed ones are of limited economic resources.
Description: El presente trabajo de investigación realizado, con el Tema: el derecho de defensa y la investigación, refleja, que toda persona detenida en (delito flagrante) o por orden de autoridad judicial (iniciado un proceso), sobre un presunto delito que se le impute, para exigir el respeto a su derecho de libertad y hacer prevalecer el principio de inocencia, consagrado en la Constitución de la República y en los Tratados Internacionales de Derechos Humanos, requiere del patrocinio de un profesional del derecho (Abogado), para que realice su defensa técnica durante el desarrollo del proceso, pudiendo ser este privado y a falta de aquel, publico. La defensa del Abogado privado, es más confiable que la pública, por cuanto este profesional, le dedica el 100 % de su tiempo al caso, haciendo todo lo posible por conseguir la ratificación del estado de inocencia de su cliente y si no lo logra por existir indicios que lo involucran, tratara de conseguir la pena mínima y la exoneración de la multa considerando la situación económica de su familia, presentando justificativos y los recursos que la ley le permite. En cambio la defensa patrocinada por el Defensor público, es limitada, por su tiempo, tiene muchas causas a su cargo, ya que la mayoría de los procesados son de escasos recursos económicos.
