Abstract: In this research will be discussed about the legal institution of proof test from the definition that makes the essayist Andrew Baytelman in his work entitled "Criminal Litigation, trial and test," which states: "It is Trial upon trial, when a dispute arises exclusively related to the accuracy, authenticity or integrity of a test " (Baytelman, 2008). It is to use this new legal trend in Ecuadorian legislation, will allow to obtain the judge's items of evidence, so that it can approach the historical truth of the facts, allowing justice without delay, based on historical truths ie an effective criminal justice. As indicated above, the present work collects information about due process as well as several themes within the criminal law that will undertake a legal and doctrinal analysis of this new legal institution finally get the approach to reform the Code of Integral Criminal in its Article 617.
Description: En la presente investigación se tratará acerca de la institución jurídica de la prueba sobre prueba a partir de la definición que realiza el tratadista Andrés Baytelman en su obra denominada “Litigación Penal, juicio oral y prueba”, donde manifiesta lo siguiente: “Se trata de prueba sobre prueba, cuando surgiere una controversia relacionada exclusivamente con la veracidad, autenticidad o integridad de una prueba”. (Baytelman, 2008). Es decir al utilizar esta nueva tendencia jurídica dentro de la legislación ecuatoriana, permitirá poder obtener al juzgador más elementos de convicción, de manera que se pueda acercar a la verdad histórica de los hechos, permitiendo una justicia sin dilaciones, basada en verdades históricas es decir en una eficaz justicia penal. Por lo antes indicado, el presente trabajo recopila información acerca del debido proceso así como de varias temáticas dentro del derecho penal que permitirán realizar un análisis jurídico y doctrinario sobre esta nueva institución jurídica y finalmente poder llegar al planteamiento de una reforma al Código Orgánico Integral Penal en su artículo 617.
