Abstract: This research work analyzes and explains what the basic points are that the litigants must consider when to pursue and justify the remedy of appeal, because as this is an extraordinary remedy is not enough to enunciate the rules infringed and the reason given, but on the contrary it is a priority to determine if the defect or error of law, fundamental to the competent judges of the National Court of Justice, can not marry in a single element is in the judgment or order which ends the processes of knowledge, partial or full degree the coming judgment, but also achieve unify criteria for the right and procedural truth and leading to the creation of binding precedent and eliminating the bad habit of the litigants that through their attorneys, defenders proceed to lodge an appeal solely for the purpose of delaying the execution of a sentence. This research is based and covered in Art. 3 and 6 of the Law of Cassation force and Art. 266 and following of the Code General Process which will take effect from May 2016.
Description: El presente trabajo investigativo analiza y explica cuáles son los puntos substanciales que las partes procesales deben considerar al momento de interponer y fundamentar el Recurso de Casación, pues por ser este un recurso extraordinario no es suficiente el enunciar las normas vulneradas y la causal invocada, sino por el contrario es prioritario determinar si en la sentencia o auto que pone fin a los procesos de conocimiento, se encuentra el vicio o error de derecho, elemento fundamental para que los Jueces competentes de la Corte Nacional de Justicia, puedan no solo casar de forma parcial o total la sentencia venida en grado, sino además, logren unificar criterios en pro del derecho y de la verdad procesal, conllevando así a la creación de jurisprudencia obligatoria y eliminando la mala costumbre de las partes procesales de que a través de sus procuradores o defensores procedan a interponer el recurso únicamente con la finalidad de dilatar la ejecución de una sentencia. Esta investigación se encuentra basada y amparada en el Art. 3 y 6 de la Ley de Casación vigente y Arts. 267 y 268 del Código Orgánico General de Procesos que entrará en vigencia a partir de mayo del 2016.
