dc.descriptionLa acción extraordinaria de protección responde a una corriente neoconstitucional, vigente en varios de los países Latinoamericanos, alineada a garantizar plenamente los derechos del hombre positivados en la Constitución, adquiriendo su condición de derechos fundamentales. La acción extraordinaria de protección se encuentra establecida en los artículos 94 y 437 de la Constitución de la República del Ecuador del 2008; precisada y desarrollada en los artículos 58 a 64 de la Ley Orgánica de Garantías Jurisdiccionales y Control Constitucional; y, en el Reglamento de Sustanciación de Procesos de Competencia de la Corte Constitucional. En el ámbito de su aplicación es necesario que exista una debida observancia de esa norma, sin incurrir en erradas interpretaciones y mucho menos omitir el contenido de ésta, a fin de mantener un debido proceso y una seguridad jurídica plena, que el Estado debe garantizar en el ámbito judicial. Si bien, los operadores de justicia deben hacer prevalecer los derechos de las personas, también el profesional del derecho tiene que estar preparado para aplicar todo su conocimiento en todo lo que implica la Acción Extraordinaria de Protección.es_ES
dc.description.abstractThe Extraordinary Protection Action responds to a neoconstitutional current, in force in several of the Latin American countries, aligned to fully guarantee the rights of man in the Constitution of the Republic, acquiring its status as fundamental rights. The extraordinary protection action is established in articles 94 and 437 of the Constitution of the Republic of Ecuador; specified and developed in articles 58 to 64 of the Organic Law of Jurisdictional Guarantees and Constitutional Control; and, in the Regulation of Substantiation of Proceedings of Competition of the Constitutional Court. In the scope of its application, it is necessary that there is due observance of this rule, without incurring misunderstandings, much less omitting the content of this, leading to maintain a full legal a due process and security that the State must retain guarantee in the judicial field. Although, justice operators must make the rights of people prevail, the legal professional must be prepared to apply all his knowledge in everything that implies the Extraordinary Protection Action.es_ES
