Abstract: Abstract: This research analyzes the scope and limits of the judicial power to order evidence for the better resolution of a case as provided for in Article 168 of the Organic General Code of Procedures (COGEP) in relation to judicial impartiality and the procedural guarantees of the parties. The issue arises because, while this power allows the judge to intervene exceptionally to clarify disputed facts when the available evidence is insufficient, its use can create risks if it ends up supplanting the evidentiary activity that is the responsibility of the litigants. An analysis of case law identifies criteria regarding the exceptional nature of such evidence, its link to disputed facts, the requirement for reasoned justification, respect for the right to challenge evidence, and the prohibition against compensating for the parties' negligence or evidentiary inaction. Consequently, the study proposes the establishment of regulatory guidelines to define the circumstances and conditions for exercising this power, seeking to balance the judge's evidentiary initiative with the preservation of judicial impartiality and procedural guarantees.

Authors: Lamilla Mendoza, Isidro Alfonso
Abstract: Abstract:This research analyzed from a legal and bibliographic perspective the ineffectiveness of state oversight regarding the implementation of prison treatment pillars in Ecuador, identifying this as an omission that violated the right to social rehabilitation for persons deprived of liberty. Employing a doctrinal-legal method and a documentary analysis of regulations, legal theory, and case law (primarily from 2022 2024), the study examined the legal framework scattered across the Constitution, the Comprehensive Organic Penal Code, and its implementing regulations identified specific instances of omission for each treatment pillar, and determined their legal consequences. The results revealed that the failure stemmed not from legislative gaps, but rather from a fragmented legal design and insufficient administrative and judicial oversight, as evidenced by Constitutional Court Judgment No. 365-18-JH/21. The study concluded that this ineffectiveness constituted a legally actionable omission and recommended strengthening regulatory and oversight mechanisms to ensure effective compliance.

Abstract: Abstract: This academic study analyzes the legal regulation of the statute of limitations in labor matters in Ecuador, placing special emphasis on the interpretive tension between Articles 635 and 637 of the Labor Code. Through a doctrinal-legal and jurisprudential analysis, the study examines the evolution of the Constitutional Court's criteria; through rulings 946-19-EP/21, 961-19-EP/24, 960-19-EP/24, and 1294-19-EP/24, the Court has established a binding precedent stating that the limitation period cannot be calculated from the termination of the employment relationship when the obligation in question was not yet enforceable at that time, but rather from the moment the worker was effectively able to exercise their right. Additionally, the study analyzes comparative law from Argentina, Chile, and Mexico, identifying mechanisms suitable for incorporation into the Ecuadorian system such as the interruption of the limitation period via administrative channels found in Argentine legislation, and the interruption of the limitation period upon the filing of a lawsuit under Mexican legislation. The study concludes that the disparity in jurisprudential criteria and the lack of explicit regulation in the Organic General Code of Procedures highlight the need for a legislative reform to unify and clarify the regulations governing the statute of limitations.

Abstract: Abstract: This research analyzes the distortion of the nature of pretrial detention within the Ecuadorian criminal justice system, emphasizing the principle of exceptionality as a constitutional limit on the restriction of personal liberty. The study begins with the observation that the practical application of this precautionary measure has deviated from its exceptional character. Adopting a qualitative approach that incorporates legal, doctrinal, and jurisprudential analysis, the study employed a documentary analysis method based on a systematic review of current regulations, legal doctrine, and the jurisprudence of the Constitutional Court of Ecuador. The results revealed that this distortion manifests through the application of automatic criteria, insufficient consideration of alternative precautionary measures, the undue prolongation of the measure, and deficiencies in judicial reasoning. As a contribution, the study proposes a legal protocol designed to strengthen judicial oversight by establishing uniform criteria for the imposition, review, and substitution of pretrial detention, thereby helping to ensure the effective application of the principle of exceptionality and the protection of fundamental rights.
