Abstract

The present work constitutes a contribution of legal and analytical information that recognizes the legal inconsistencies that currently undermine the fulfillment of the Constitutional Law to a healthy environment, developing an analysis on all the legal regulations that surround to him and that is estimated not completely guarded by the Wellness of the experience in urbanizations located in the way to the coast of the city of Guayaquil. The environment, as well as belongs to all citizens who are given the right to enjoy it, but in turn the duty to care for it, since its pollution would make impossible the exercise of any other right, was recognized in the Constitution. The present study analyzes the urban activities of the sector, resulting in damages and damages in the same as a result of quarrying, deforestation and urban activities; The document provides the reader with a broad vision of quarry exploitation activities, the regulations that revolve around them, consequences and affectations for residents, summarizing the breach of the constitutional right to a healthy environment
