Abstract

Abstract: The Ecuadorian Constitution explicitly states that it guarantees legal security; that this is manifested in respect for the existing legal regulations; and that it corresponds to all judicial bodies to exercise it; On the other hand, it is not represented in the decisions of the justice operators, that is, there is a contradiction between the established norm and the execution of these by those in charge of applying justice. Legal security is manifested in respect for the legal system established through the positivist system that governs our nation, that is to say that the state must guarantee coexistence among the people who inhabit a space, and to guarantee this, it must resort to affirming the right and above all to foresee that norms outside our legal system can alter the regimes of harmony, the same ones that were created with the punctuality of dissipating social conflicts.
