| Abstract: | This research work deals with the implications of constitutional interpretation as a main tool for the development of the rights contained in the Constitution and its functionality within the New State Model. It is based on the analysis of different methods and techniques of interpretation: grammatical, historical, logical and systematic which are regarded up to the present time as the main application tools for jurisprudence; also the different legal conceptions that determine the functionality, structure and development of the elements that make up each method of interpretation have been considered. The interpretative activity within the constitutional sphere implies changes in the matter of fundamental rights, determining in this way the importance that is given to the modern interpretation tools like the principle of proportionality and the weighting for the effective protection and structure of the fundamental rights. |
| Description: | El presente trabajo trata sobre las implicaciones de la interpretación constitucional como herramienta principal para el desarrollo de los derechos contendidos en la constitución y su funcionalidad dentro del nuevo modelo de Estado. Partiendo del análisis de los diferentes métodos y técnicas de interpretación: gramatical, histórica, lógica y sistemática las cuales se conforman hasta la actualidad como las principales herramientas de aplicación para la jurisprudencia; y las diferentes concepciones jurídicas que determinan la funcionalidad, estructura y desarrollo de los elementos que conforman a cada método de interpretación. La actividad interpretativa dentro de la esfera constitucional trae consigo cambios en materia de derechos fundamentales, determinando de esta manera la importancia que se otorga a las herramientas de interpretación modernas como el principio de proporcionalidad y la ponderación, para la efectiva protección y estructura del contendido de los derechos fundamentales |
