| Abstract: | Abstract: It aspires to know the daily reality that men and women must assume, if the respect for their constitutional rights is fully given and if the State fulfills that obligations of being a guarantor of rights for this groupof people deprived of their liberty, who arein a situation of vulnerability.The present investigative work seeks to investigate if the process of social rehabilitation is currently successful as the State guarantees the person who has been deprived of liberty. Being a guarantee system that is bases on the most notorious regulations and of greater legal weight. Such as the Constitution of the Republic of Ecuador and the Comprehensive Organic Criminal Code.Our contribution will be based on the verification or not, of the existence of the violation of the rights of Persons Deprived of Liberty, if the programs used for optimal rehabilitation and reintegration are absolete or it they still retain their initial purpuose. Evidenced if the State guarantees rights and makes use of its power for the benefit of this social group. |
| Description: | Resumen: Se aspira conocer la realidad diaria que hombres y mujeres deben asumir, si el respeto por sus derechos constitucionales se da de manera plena y si el Estado cumple con las obligaciones de ser garantista de derechos para este grupo de personas privadas de su libertad, las cuales se encuentran en situación de vulnerabilidad. El presente trabajo investigativo busca indagar si el proceso de rehabilitación social es actualmente fructuoso y cómo el Estado garantiza el cumplimiento y no violación de los derechos constitucionales de la persona que ha sido privada de su libertad por el cometimiento de un delito. Siendo un sistema garantista que se apoya en las normativas más notorias y de mayor peso legal, como lo es la Constitución de la República del Ecuador y el Código Orgánico Integral Penal. El aporte que arrojará el presente trabajo se basará en la comprobación o no de la vulneración a los derechos constitucional es de las personas privadas de libertad(PPL); y, si los programas que se utilizan actualmente para una óptima rehabilitación y reinserción son obsoletos o si aún conserva su finalidad inicial. Para lo cual, se evidenciará si el Estado garantiza derechos y hace uso de sus facultades en beneficio de este grupo social. |
