| Abstract: | Abstract: Health is the physical, mental, social state of a person that allows him to continue living and overcome difficulties and inconveniences, it is related to affectations or diseases, health is closely related to the economic development of a country, we must consider that health is a right of the people and is guaranteed by the state, this right is conceived and stipulated in the Constitution of the country. Therefore, in this present work it is reported the analysis of the arguments of the judges against a possible violation of the right to health is reported, under the subject of Human Rights and Constitutional Law and the relationship with the Sustainable Development Goals SDGs, in order to know the rights that the state and the constitution guarantee and provide to each citizen, the analysis will be carried out with a ruling of the Constitutional Court issued in Ecuador. Finally, as a result of the analysis, I will check whether the judges' arguments were adequate and correct, based on Human Rights and Constitutional Law. |
| Description: | Resumen: La salud es el estado físico, mental, social de una persona que le permite seguir viviendo y superar dificultades e inconvenientes, está relacionado con las afectaciones o enfermedades, la salud está estrechamente relacionada con el desarrollo económico de un país, debemos considerar que la salud es un derecho de las personas y es garantizado por el estado, este derecho está concebido y estipulado en la Constitución del país. Por tanto, en el presente trabajo se reporta el análisis de los argumentos de los jueces frente a una posible vulneración del derecho a la salud, bajo la materia de Derechos Humanos y Derecho Constitucional y la relación con los Objetivos de Desarrollo Sostenible ODS, con el objeto de conocer los derechos que el estado y la constitución garantizan y proporcionan a cada ciudadano, el análisis se lo realizará con una sentencia de la Corte Constitucional emitida en Ecuador. Finalmente, como resultado del análisis comprobaremos si los argumentos de los jueces fueron los adecuados y acertados, con base a los Derechos Humanos y Derecho Constitucional. |
