Abstract

Abstract: One of the public health problems in our Ecuador is directly linked to the consumption, trafficking and possession of drugs. both article 364 of the constitution of the republic and article 220 of the COIP, indicate the predisposition of the Ecuadorian State to mitigate this problem. The Technical Secretariat for Comprehensive Drug Prevention (SETED) has created a table that regulates the possession of all psychotropic substances, as well as the methods that must be used for their control and the difference between people who consume and those who traffic, with the respective sanction to the offender, for possession of quantities of psychotropic substances. I will point out the problem of drug trafficking that motivated Resolution Number 02-2019 and the competition of infractions, competition of crimes; analyze whether or not the infractions should be judged separately according to the number of crimes attributable to the carrier of psychotropic substances. The objective of this work is to propose a return to the real contest of crimes, taking into account some recommendations that I will propose at the end, and above all as a sign of wanting to do things well for this country, my country.
