Abstract

Abstract: This degree work is based on the study of judgments issued by Superior Courts of Justice, from 2015 onwards, focused on the Sustainable Development Objectives according to the rights protected by this objective. In this case we will talk about the right to due process, legal certainty, the principle of motivation, based on the study of a sentence issued by the National Court of Justice, projected to Criminal and Criminal Procedure law, in relation to ODS 16, the same one that speaks on Peace, Justice and Solid Institutions.The objective of this brief work is, from the verification of the existence of the lack of consideration by art of the Judges to these principles, and to the conception of legal security, in a subjective or objective way, to critically examinethe degree of compliance that is observed in the practice of criminal law, of the requirements that each of these norms emanate.In Ecuador and other Latin American countries, at least in theory, motivation is considered as one of the fundamental elementsof prevention and control in the face of arbitrariness in the appreciation of the judges' evidence and as a presupposition of the right to resources.
