| Abstract: | Abstract: The present research paper entitled "Academic preferences of Law students and their link with the Sustainable Development Goals (SDGs) through the study of sentences" investigated the relationship between Environmental Law, Sentence No. 22-18-IN/21 of the Constitutional Court of Ecuador and Sustainable Development Goal No. 13: Climate Action. First, the importance of the SDGs and the doctrinal and legal references related to SDG No. 13 Climate Action are analyzed. Likewise, the research contribution achieved through this work is to analyze the mentioned sentence, in order to know the entitled rights and the regulations presented in it: which would be the rights of Nature and its relation with the rights of Good Living; and regulations such as the Constitution of Ecuador, the Environmental Code and the Regulations to the Environmental Code, as well as International Treaties related to environmental protection. Doctrinally, the Biocentric and Anthropocentric currents are analyzed with respect to the recognition of Nature as a right holder. |
| Description: | Resumen: El presente trabajo investigativo titulado Preferencias académicas de los estudiantes de la Carrera de Derecho y su vinculación con los Objetivos de Desarrollo Sostenible (ODS) a través del estudio de sentencias investigó la relación entre el Derecho Ambiental, la Sentencia No. 22-18-IN/21de la Corte Constitucional del Ecuador y el Objetivo de Desarrollo Sostenible Nro. 13: Acción por el clima. En primer lugar, se analiza la importancia de los ODS y las referencias doctrinarias y jurídicas relacionas con el ODS Nro: 13 Acción por el clima. Así mismo, el aporte investigativo que se logra a través de este trabajo es analizar la sentencia mencionada, con el fin de conocer los derechos titulados y la normativa presentada en ella: los cuales serían los derechos de la Naturaleza y su relación con derechos del Buen Vivir; y normativa como la Constitución del Ecuador, Código del Ambiente y el Reglamento al Código del Ambiente, así como Tratados Internacionales relacionados con la protección ambiental. Doctrinariamente, se analiza la Corriente Biocentrista y la Corriente Antropocentrista respecto al reconocimiento de la Naturaleza como titular de derecho. |
