Abstract

Abstract: Throughout history there have been different economic, political and social elements that have caused a forced displacement of people. The fact that they have to flee their country of origin and are forced to cross the borders looking for international protection forces Ecuador to have minimum guarantees in the process of recognizing refugee status, especially when this Andean country is considered as destination and transit of people in human mobility. With this background, from the perspective of the protection and guarantee of human rights the Judgment No. 897-11-JP/20 of August 12, 2020 of the Constitutional Court is analyzed, framed in the Sustainable Development Goal number 10.7, referring to the promotion of orderly, safe, regular and responsible migration; including through the implementation of properly planned and managed migration policies. The present investigation contributes to the debate and promotes the institutional commitment with the fulfillment of the referred judgement.
