Abstract

Abstract: In the present research work, the study of Judgment No. 053-15SEP-CC was carried out, promulgated by the Constitutional Court of the Republic of Ecuador, in which an Extraordinary Protection Action is presented that arises from a complaint filed for an attempted of rape; and with this development it bases us on the analysis and link with the Sustainable Development Goals SDG, specifically with objective No. 16 that states "Conflicts, insecurity, weak institutions and limited access to justice continue to pose a serious threat for sustainable development . The Constitutional Court, analyzing the foregoing and administering justice, resolves the following: "declares the violation of the constitutional rights to due process, right to defense, effective judicial protection, due motivation and legal certainty enshrined in article 76 numeral 1 and 7 and 82 of the Constitution of the Republic", therefore, under the guidelines of this work, the scope of the basic guarantees due process, right to defense, effective judicial protection, due motivation and legal security for the enjoyment of the recognized rights is analyzed. by the Constitution; and how these are linked to the Sustainable Development Goals SDG and mainly with No. 16.
