| Abstract: | Abstract:The study carried out focused its objective on analyzing and knowing the importance of the SDG No. 16 and its connection with the scope and foundations of the protected rights on the peace, justice and strong institutions. For this, the application of habeas corpus was considered, given that, in the field of criminal law, it has been possible to identify several problems regarding the violation of the rights of people who were deprived of their liberty in the different social rehabilitation centers that exist in the Ecuadorian territory. The The methodology used was framed in a mixed approach, since processes were used statistics based on rulings handed down by justice bodies, such as the Court National Court of Justice, the Electoral Contentious Tribunal and the Inter-American Court of Rights Humans, with a search range dating between 2015 and 2020 and a database with 4450 sentences. The development of these analyzes addressed the importance, achievements, scope, connection with judgment No. 365-18-JH/21 and accumulated due to Integrity staff of persons deprived of liberty. |
| Description: | Resumen: El estudio realizado centró su objetivo en analizar y conocer la importancia del ODS Nro. 16 y su vinculación con los alcances y fundamentos de los derechos tutelados sobre la paz, justicia e instituciones sólidas. Para ello, se consideró la aplicación del habeas corpus, dado que, en la materia de derecho penal, se ha podido identificar varios problemas sobre la vulneración de los derechos de las personas que estaban privadas de su libertad en los diferentes centros de rehabilitación social que existen en el territorio ecuatoriano. La metodología utilizada se enmarcó en un enfoque mixto, por cuanto se utilizó procesos estadísticos basados en los fallos de dictados por los órganos de justicia, tal como fue la Corte Nacional de Justicia, el Tribunal Contencioso Electoral y la Corte Interamericana de Derechos Humanos, con un rango de búsqueda que data entre 2015 y 2020 y una base de datos con 4450 sentencias. El desarrollo de dichos análisis abordó la importancia, logros, alcances, vinculación con la sentencia No. 365-18-JH/21 y acumulados en razón a la Integridad personal de personas privadas de libertad. |
