Abstract

Abstract: The present investigation analyzes the violation of the right to due process by the first Civil Chamber of the Provincial Court of Azuay with trial No. 703-13 homologation of divorce sentence. The Constitutional Court considers the minimum requirements, these help to establish whether the decision is duly founded, these being reasonableness, logic and understandability. Analyzing what was stated by the Provincial Court in the sentence, there is evidence of a lack of logic, coherence between the exposed premises. Additionally, the norm transgressed or the reasons for the aforementioned violation are not specified, for this reason the right to due process in reference to the motivation is considered violated. From this perspective, the sentence that requests extraordinary protection action is linked to SDG No. 16, which is framed in peace, justice and solid institutions. Within this SDG, some rights are protected, highlighting effective judicial protection. However, due to Covid 19, there are setbacks in the progress of the SDGs to achieve the goals set out in the 2030 agenda.
