Abstract: The sentence has been selected study is within the established parameters, issued between the year 2015 to 2020, it was chosen in form and personal analysis to deepen more in the subject related to Administrative Law of the Organ of the contentious Electoral court with case No. 023- 2019-TCE, entity in charge of regulating the approval for a person to opt for a dignity of popular election, that is, a public office, prevailing over the political subjects and the exercise of their respective rights, with an application of the principles of autonomy, independence, publicity, transparency, equity, interculturality, gender parity, promptness and probity. In such a way it is where controversy of this cause is generated, which is based mainly on the fact that Mr. Mariano Curicama, who can demonstrate that the candidacy for rural councilor of Mr. Anibal Chafla is fully suitable and qualified for registration, which is being questioned, for not complying with the regulations that regulate the TCE, since it was affiliated with another political party, different from the one that is seeking a seat, therefore, the appeal is denied. In which the National Electoral Council will have as its primary function, organize, direct, monitor and transparently guarantee the entire electoral process in a truthful and timely manner.
