Abstract:In Ecuador, the right to health and the scope of all its mandatory benefits are are guaranteed in the Constitution of the Republic of Ecuador of 2008 as a public, timely and quality service for all people without any kind of discrimination, which is why the United Nations Organization and the Universal Declaration of Human Rights of 1948, established that the health service is a right to an acceptable and adequate standard of living in the 2030 Agenda within the Goal of Sustainable Development number 3, adding to it the analysis of sentence 016-16- SEP-CC issued by the Constitutional Court of Ecuador constitute the central theme of the present investigation; study that allows the graduates of the career of right of UTPL your future specialization through academic preferences of legal science, for this purpose a projective legal investigation was carried out and exploratory, based on the exegetical method, signing techniques and an investigation in line, through which it is determined if our judicial and constitutional system provides an administration of justice that generates social peace and legal security.
