Abstract

Abstract: Judgment No. 904-12-JP/19 delivered in the city of Quito on December 13, 2019 is the subject of analysis in constitutional matters, on the violation of the right to health and the right to social security, as well as treating obstetric violence in Ecuador, the Ecuadorian Social Security Institute (IESS), causes, factors and consequences to the physical and psychological state of the pregnant woman and the newborn. Detailed and interpreted public policies against maternal mortality and vulnerability of the right to health with the most recent data and figures on this social problem together with the linkage of the Sustainable Development Goals (SDGs), focusing on objective No. 3: Health and Well-being. It introduces a historical framework on evolution of the health area in Ecuador, advances in regulations and professional care, as well as the identification of various errors that obstruct dignified, supportive and effective. Similarly, the current legal status of legal actions is evaluated. presented to cease the violation of rights in relation to health.
