Abstract

Abstract: The Sustainable Development Goals (SDGs), adopted by world leaders on September 25, 2015, seek to involve all people, civil societies, governments, companies, in order to achieve the objectives set for the benefit of future generations, aimed at protecting the planet, eradicating poverty, building a more prosperous, fair, and sustainable world; it proposes 17 SDGs, which these intend to achieve through solid global associations committed to each of the proposed objectives. In reference to judgment No. 50-21-CN/22 and accumulated from the Constitutional Court of Justice, the ODS related to this case is No. 16. It seeks to promote fair, peaceful and inclusive societies. This judgment analyzes a Constitutional consultation of the norm with respect to Resolution with Force of Law No. 02-2016; since it is considered contrary to Article 77 numeral 1 and 12 of the Constitution of the Republic of Ecuador, in relation to the principles of legality and favorability, and Articles 11 numeral 2 and 66 numeral 4 of the same legal text. The Constitutional Court also pronounces on the constitutionality of Art. 630 of the COIP.
