| Abstract: | Abstract: The main objective of this degree work is to know the factors that appear in the Graduate of the Law Career of the UTPL that serve to develop preferences of specific areas in the legal sciences, including these within the context and importance of the 2030 Sustainable Development Goals, specifically in objective Nro. 16 PEACE, JUSTICE AND SOLID INSTITUTIONS. For this reason, we are going to analyze legally how there has been violation of human rights and breach of the Constitution. This paper analyzes the criminal process signed with No. 13284-2018-01033, in which the specialized Chamber of criminal, military criminal, police criminal, traffic, corruption and organized crime of the National Court of Justice accepts the appeal of cassation for having violated the guarantee of motivation that is which is covered by Art.76. numeral 7 literal i) of the CRE. In this sense, aspects have been analyzed in the application of the right to effective judicial protection, legal certainty, and good public administration, from a legal, doctrinal and its execution for implementation. |
| Description: | Resumen: El presente trabajo de titulación tiene como principal objetivo conocer los factores que aparecen en el Egresado de la Carrera de Derecho de la UTPL que sirven para desarrollar preferencias de áreas específicas en las ciencias jurídicas, comprendidas estas dentro del contexto y la importancia de los Objetivos de Desarrollo Sostenible 2030, específicamente en el objetivo Nro. 16 PAZ JUSTICIA E INSTITUCIONES SOLIDAS. Por tal motivo, vamos a analizar jurídicamente como ha existido vulneración de derechos humanos e incumplimiento de la Constitución. En el presente trabajo se analiza el proceso penal signado con el No 13284-2018-01033, en el cual la Sala especializada de lo penal, penal militar, penal policial, tránsito, corrupción y crimen organizado de la corte nacional de justicia acepta el recurso de casación por haber vulnerado la garantía de motivación que está amparado en el Art.76. numeral 7 literal i) en la CRE. En este sentido, se ha analizado aspectos en la aplicación del derecho a la tutela judicial efectiva, seguridad jurídica y buena administración pública, desde un plano jurídico, doctrinario y su ejecución para la implementación. |
