Abstract

Abstract: The degree work that I have developed analyzes Development Objective N.-16 Sustainable Development Goals (SDG), its rights and its achievement, we randomly relate it to the study of a selected sentence which was issued by the National Court of Justice of Ecuador in a process of challenging paternity by declaration judicial, case No. 11203-2018-01696, in which we identify the objectives of SDG 16: Peace, Justice and Solid Institutions and their rights such as: access to justice quality, legal certainty, effective protection and we analyze them. During our study We show that in the case study the filiation of a son who was recognized through judicial means at the expense of this recognition, the father initiates countless judicial actions such as: preparatory DNA diligence, annulment of sentence, challenge of paternity, the latter being a reason for analysis, during the substantiation of this case, the lack of due judicial diligence is evident, the heterogeneity of judicial criteria; This entire compendium will focus on the importance of appropriate judicial resolutions regarding social problems.
