| Abstract: | Abstract: Abortion in the Ecuadorian legal framework based on legal tensions in domestic law and international instruments is an existing legal conflict that cannot be denied and that responds to a high influence of political and religious institutions. For this reason, a theoretical and legal analysis is carried out. The methodology used is clearly dogmatic legal, for which legal interpretation methods will be used, in accordance with what is established in the Article 3 of the Organic Law of Jurisdictional Guarantees and Constitutional Control. The frame Theoretical is made up of the constitutionality block in the Ecuadorian State. Definition of constitutionality block and its formation. Constitutional block in sense strictly and in a broad sense, in which case we will rely on authors such as Zagrebelsky, Ferrajoli, Ávila Santamaría, Uprimny, Dworkin, among others. The Ius Cogens versus internal law. The advisory opinions of the Inter-American Court within the Ecuadorian legal framework. Internal regulations versus the pacta sunt principle servender. Likewise, an analysis of the Control of conventionality and abortion is carried out, a definition of conventionality control and its origin. The rulings of the Inter-American Court and its Erga Omnes effect, as well as the tensions identified between the external and the internal and its favorability towards abortion and the legality of abortion in comparative law. | Description: | Resumen: El aborto en el marco jurídico ecuatoriano a partir de las tensiones jurídicas en el derecho interno y los instrumentos internacionales es un conflicto jurídico existente que no se puede negar y que responde a una alta influencia de instituciones políticas y religiosas. Por ello se realiza un análisis teórico y jurídico. La metodología utilizada es netamente dogmática jurídica, para lo cual se usarán métodos de interpretación jurídica, conforme lo establecido en el artículo 3 de la Ley Orgánica de Garantías Jurisdiccionales y Control Constitucional. El marco teórico está compuesto por el bloque de constitucionalidad en el Estado ecuatoriano. Definición de bloque de constitucionalidad y su conformación. Bloque de constitucionalidad en sentido estricto y en sentido lato, en cuyo caso nos respaldaremos de autores como Zagrebelsky, Ferrajoli, Ávila Santamaría, Uprimny, Dworkin, entre otros. El Ius Cogens frente al derecho interno. Las opiniones consultivas de la Corte Interamericana dentro del marco jurídico ecuatoriano. La normativa interna frente al principio pacta sunt servanda. Así mismo se realiza un análisis del Control de convencionalidad y el aborto, una definición del control de convencionalidad y su origen. Las sentencias de la Corte Interamericana y su efecto Erga Omnes, así como las tensiones identificadas entre lo externo y lo interno y su favorabilidad frente al aborto y la legalidad del aborto en derecho comparado. La presente investigación por ende permite comprender El aborto en el marco jurídico ecuatoriano a partir de las tensiones jurídicas en el derecho interno y los instrumentos internacionales. |
