Abstract

Abstract: Health is a right and a public service with a broad legal, national and internationally, and in our Ecuadorian territory it is guaranteed in the Constitution of the Republic, a service that must be timely, acceptable, affordable and of quality for everybody; For this reason, the United Nations, in order to protect this right arises within the Sustainable Development Goals of the 2030 Agenda; the SDG No3 (health care); which, together with the analysis of Sentence No.904-12- JP/19 issued by the Constitutional Court constitute the central topic of this research, study that makes it easier for me as a law graduate to develop my future specialization in specific areas of legal science; For this purpose, it was carried out a projective and exploratory legal investigation, based on the exegetical method, techniques of signing and an online investigation, a study that allows us to contribute to the solution of legal problems and those that arise in women throughout the process of pregnancy and childbirth, avoiding cases of obstetric violence, indicate the aforementioned how it responded to the problem posed, the scope of its objectives and compliance.
