| Abstract: | Abstract: The present investigation is based on the doctrinal and legal foundations of the Criminal Law, a matter that regulates the punitive power of a Constitutional State of law and justice, which will be analyzed from the legal link between the Objective of Sustainable Development ​​SDG No. 16 Peace, Justice, and Solid Institutions in charge of establish guidelines to build a peaceful, secure society attached consciously to the laws and the right; and ruling No. 14255-2019-01263 of the Court National Court of Justice of Ecuador, in which a sentence for homicide is revoked, due to vices in the process. To give an analytical meaning to this research and examine the rights it protects SDG No. 16 and which in turn are violated within the sentence subject to study, both national and international doctrinal and legal precepts were established which allowed the author of this thesis to determine concepts, definitions and studies own legal principles that gave meaning to the link between the chosen subject, Ods No. 16 and the Judgment. |
| Description: | Resumen:La presente investigación tiene como base los fundamentos doctrinarios y legales del Derecho Penal, materia que regula la potestad punitiva de un Estado Constitucional de derecho y justicia, misma que se será analizada desde el vínculo jurídico entre el Objetivo de Desarrollo Sostenible ODS No. 16 Paz, Justicia, e Instituciones Sólidas encargada de establecer lineamientos para construir una sociedad pacífica, segura apegada conscientemente a las leyes y el derecho; y la sentencia No. 14255-2019-01263 de la Corte Nacional de Justicia del Ecuador, en la cual se revoca una sentencia por homicidio, debido a vicios en el proceso. Para dar un sentido analítico a esta investigación y examinar los derechos que tutela el ODS No. 16 y que a su vez se encuentran vulnerados dentro de la sentencia objeto de estudio, se estableció preceptos doctrinales y jurídicos tanto nacionales como internacionales los cuales permitieron a la autora de esta tesis determinar conceptos, definiciones y estudios jurídicos propios que dieron sentido al vínculo entre la materia escogida, el Ods No. 16 y la Sentencia. |
