Abstract

Abstract: This research is based on the link with Sustainable Development Goal No. 16 (SDG), which consists of Peace, Justice and Strong Institutions through the study of the sentence No. 005-16-SEP of the Constitutional Court, which declared the violation of the right to effective judicial protection and due process in the basic guarantee of the right to defense. For this purpose, it has been proposed to analyze the relationship of the protected rights of SDG No. 16 with the right violated in the selected sentence with the matter of preference, which in this case is criminal. Effective judicial protection is considered a fundamental right and a procedural principle, since it is directly related to access to justice and defense, and the State will be the guarantor of the protection of these rights. The case of the judgment will be studied, in order to determine how the Sustainable Development Goals fulfill their purposes of providing access to justice for all and building effective, accountable and inclusive institutions at all levels.
