| Abstract: | Abstract: A study was carried out on the Ruling of the Constitutional Court No. 376-20-JP/21, that contributed to the strengthening of the country's judicial system given that it recognizes the right to legal certainty, since the principle of proportionality is guaranteed by This drives Sustainable Development Goal number 16, which is based on access to quality justice, right to effective judicial protection, right to good public administration. By recognizing and protecting this right, the court promotes the respect for the fundamental rights of citizens, which strengthens trust in the judicial power and the institutions in charge of it. The investigation developed is of an investigative legal nature, because approximations were analyzed prior to the situational scenario of legal phenomena. The conclusion is that, the analyzed sentence focuses on issues related to legal security, access to quality justice, the right to effective judicial protection and the right to good public administration that promotes full respect for the principle of proportionality and women's sexual rights. |
| Description: | Resumen: Se realizó un estudio sobre la Sentencia de la Corte Constitucional No. 376-20-JP/21, que contribuyó en el fortalecimiento del sistema judicial del país dado que reconoce el derecho a la seguridad jurídica, pues se garantiza el principio de proporcionalidad por ello impulsa el Objetivo de Desarrollo Sostenible número 16, que se basa en el acceso a justicia de calidad, derecho a la tutela judicial efectiva, derecho a la buena administración pública. Al reconocer y proteger este derecho, el tribunal promueve el respeto a los derechos fundamentales de los ciudadanos, lo que fortalece la confianza en el poder judicial y las instituciones encargadas del mismo. La investigación desarrollada es de carácter jurídico investigativo, porque se analizaron aproximaciones previas al escenario situacional de los fenómenos jurídicos. La conclusión es que, la sentencia analizada enfoca temas relacionados con la seguridad jurídica, acceso a la justicia de calidad, derecho a la tutela judicial efectiva y derecho a la buena administración pública que promueve el pleno respeto del principio de proporcionalidad y los derechos sexuales de las mujeres. |
