Abstract

Abstract: The Constitutional Court of Ecuador issued ruling No. 239-17-EP in response to a custody dispute over a girl and boys between the mother and paternal grandmother. The provincial decision, which ordered the immediate delivery of the minors to the mother, was annulled by the Court considering that it violated the fundamental rights of the childhood, including due process and the right to be heard. As a measure of reparation, the medical and psychological care of the girl and boys was prioritized, ruling highlights the importance of considering the best interests of the child in decisions judicial processes and their relevance to Sustainable Development Goals such as health and well-being, gender equality, and peace, justice and strong institutions. They identify the protected rights, linking them with the Sustainable Development Goals (SDGs) and legal regulations. In addition, recommendations are proposed for future investigations in the field of family custody and children's rights. This job highlights the relevance of judicial decisions in the protection of rights children, promoting equity and sustainable development.
