Abstract

Abstract: In the graduation thesis, the judgment of the Inter-American Court of Human Rights in the case of María and Others vs. Argentina is addressed with the primary objective of analyzing the legal and social implications of this case. It describes the situation of a young 13-year-old mother, María, who is of limited economic means and whose separation from her newborn child was carried out without following the proper legal process, as the established protocols for adoption in Argentina were not respected. This included bypassing the lottery system and separating María from her mother at the time of granting permission for the adoption. The study aims to examine the violation of human rights, specifically in relation to Sustainable Development Goal (SDG) number 5. This goal becomes the fundamental framework for understanding and addressing the deficiencies in the adoption and guardianship process that affected María and her child. The thesis seeks to analyze the content of the judgment, highlighting the procedural errors and the failure to comply with international standards in the protection of human rights.
