Abstract

Abstract: Within the framework of this research, an exhaustive analysis of freedom of expression in the democratic history of Ecuador is carried out, with the objective of identifying the mentions, relationships and characteristics of the recognition of freedom of expression in constitutional texts. The research uses qualitative methodology to study social and human phenomena in the constitutions since the beginning of the Republic, focused on the understanding and interpretation of the subjective meanings and experiences of people through content analysis and semi-structured interviews with experts in the field, legislative and journalistic field. The results obtained allowed us to establish concepts from a theoretical perspective on democracy, constitutionalism and fundamental rights. As well as a historical x-ray of the political, economic and social context in which the Constitutions that defined the rights and duties of citizens from 1938 to 1978 were drafted. In addition, new areas of research emerged, such as the need to regulate freedom of expression. expression in the technological context without compromising the natural right to give an opinion and express oneself.
