Abstract

Abstract: The study carried out on ruling No. 791-21-JP/22 issued by the Constitutional Court of Ecuador is based on a critical and argumentative analysis, since it considers important aspects such as justice and application of the law. Consequently, in the present case the violation committed is specified in the omission of different rights, such as the right to gender equality and non-discrimination, which are directly linked to the rights protected by Development Goal No. 5. and in turn, with the subject of Human Rights since these sections ensure a wide range of rights and guarantees inherent to human beings, thus promoting justice and equality without any discrimination. It is for this reason that the investigative analysis of the work carried out is relevant since it makes visible certain problems in gender inequality and the most appropriate way to proceed in analogous situations. In addition, it is a constant reminder of the importance of guaranteeing gender equality and non-discrimination for all people regardless of their condition.
