Abstract

Abstract: This work was developed through the study of ruling No. 328-22-EP/22 and its connection with the Sustainable Development Goal from now on [SDG], when analyzing the violation of the right to due process in the guarantee of recourse to the ruling or resolution, stipulated in the Constitution art. 76 numeral 7 literal m (National Assembly of Ecuador, 2008), taking into consideration that this impossibility of exercising the right to appeal violates the constitutional norm and the different international treaties and conventions signed by Ecuador. Through the analysis of constitutional law, the violated right has been identified, this gives the guideline for sanctioning the corresponding authorities that have committed the violation, and it is also evident that SDG No. is not being complied with. 16 since we are facing justice bodies that are weak and do not guarantee just, peaceful and inclusive societies. Certainly this ruling has affected the implementation of SDG No. 16, because according to what it establishes it is about peace, justice and solid institutions, by not allowing the plaintiff to appeal, they are being denied access In terms of justice, it is also evident that there are no solid institutions, since they do not comply with what is established by said objective.
