Abstract

Abstract: The present research and analysis work was carried out based on the study of a judgment of Extraordinary Action of Protection, which was issued by the Constitutional Court of Ecuador No. 209-15-SEP-CC, related to the subject family Right, where like controversy object it is a preparatory diligence No. 1348-2013 dictated by the fifteenth judge of the childhood and adolescence of Steal, in a case of ratification of parenthood, where there were damaged constitutional rights that commit an outrage against the due process and to the Top Interest of the Girls, Children and Adolescents, being this judgment linked with the Target of Sustainable development (ODS) 16, which is categorically based on structuring, creating and ensuring in a harmonious and peaceful way within our Ecuadorian State a solid institution of justice as a fundamental requirement in the light of the complexity of the problems presented in advance regarding the lack of solid structures on the part of our Organs of Justice, being the end, to give solutions in a transcendental way in order to remedy the damage presented, thus, in the care of the Ecuadorian family and the best interests of the child, Ratified in the International Conventions and Treaties, it was concluded with a favorable ruling, first protecting the rights of the mother as guardian of the child and second protecting the rights of the girl child because Ecuador, as guarantor of rights, has a primary duty to ensure that these rights are implemented taxatively.
