Abstract

Abstract:This research work analyzes how the violation of the fundamental rights of the prosecuted people affects the fulfillment of the Sustainable Development Goals worldwide, through these objectives it is intended to achieve a fair, equal and equitable society for the citizens belonging to to society. Specifically, this research focuses on the study of Sustainable Development Goal No. 16, which focuses on creating and promoting Peace, Justice and Solid Institutions, guaranteeing equal justice for all. This objective has been related to a cassation ruling with a ruling from the National Court of Justice of Ecuador, for a case of a person already prosecuted for the crime of murder, where the principle of proportionality of the penalty and the violation of her rights, since the defendant belongs to an indigenous community. The case analyzed demonstrates the commitment of the Ecuadorian justice system to the ideals of justice and equality that are raised in SDG 16 regardless of ethnic origin or condition.
