Abstract

Abstract: The central objective of this master's thesis project is to propose a review and legislative adjustment to the Mining Law and its Regulations in Ecuador, with a specific focus on codifying the mandatory compliance with prevention mechanisms for diseases and workplace accidents within the mining industry. The research is based on the analysis of the regulatory structure, from the Constitution to mining legislation and regulations, highlighting the normative interconnection. The importance of this proposal lies in the need to strengthen the supervision of the mining industry, especially in terms of occupational safety and health, given the inherently hazardous nature of the industrial activity. Additionally, the project aims to identify regulatory deficiencies, evaluate the implementation of existing preventive measures, and design specific legislative reforms that promote international safety and health standards within the country. The validation of the legislative proposal will ensure its feasibility, thus contributing to the improvement of working conditions and the protection of the rights of miners in Ecuador.
