Abstract: In this investigation we will address the request for a DNA test, in which it is planned to determine the paternity of the minor, therefore, we seek to protect and guarantee the rights stipulated to children and adolescents to identity, and to the provision of food, to the best interest, therefore as determined by the Code of Children and Adolescence in which the results of the test can be guaranteed through the DNA test. As stipulated in Art. 98, which mentions the following: A biological family is understood to be that formed by the father, the mother, their descendants, ascendants and collaterals up to the fourth degree of consanguinity, adopted boys, girls and adolescents are assimilated to the biological children, for all purposes the adoptive father and mother are considered parents. And that is why the Republic Constitution endorses it in Art. 40, stipulating that the State itself will protect mothers, fathers and those who are heads of families, in the exercise of their obligations, and in this way co-responsibility will be promoted. Paternal and maternal and monitor the fulfillment of reciprocal duties between parents and children. That is why an analysis has been carried out of ruling No. 259-15-SEP-CC of the Constitutional Court, corresponding to the year 2015, in which various rights have been forcefully violated.
