| Abstract: | Abstract: The present investigative work called jurisprudential analysis of the protection action, is based on the need to reproach the distortion of this jurisdictional guarantee. This denaturalization of the protection action comes from the lack of adequate protection of constitutional rights by lawyers; as well as the administrators of justice, which leads to serious transgressions of the rights and procedures established by the Organic Law of Jurisdictional Guarantees and the jurisprudence of the Constitutional Court. In the course of this investigation, an analysis is made of several rulings issued by the Constitutional Court correcting the arbitrary and illegitimate use of the protection action in our country. |
| Description: | Resumen: El presente trabajo investigativo denominado análisis jurisprudencial de la acción de protección, parte de la necesidad de reprochar la desnaturalización de esta garantía jurisdiccional. Esta desnaturalización de la acción de protección proviene de la falta de una tutela adecuada de los derechos constitucionales por parte de los abogados; así como de los administradores de justicia, lo que conlleva a graves transgresiones de los derechos y de los procedimientos establecidos por la Ley Orgánica de Garantías Jurisdiccionales y la jurisprudencia de la Corte Constitucional. En el transcurso de esta investigación se hace un análisis a varias sentencias emitidas por la Corte Constitucional corrigiendo el uso arbitrario e ilegítimo de la acción de protección en nuestro país. |
