Abstract

Abstract: The Sustainable Development Goals (SDG) were created in order to improve the quality of life of people. SDG (8) in relation to labor law, seeks to guarantee access to decent employment, promote fair and safe working conditions, eradicate forced labor and modern slavery, promoting labor formalization and equal opportunities in the workplace, these aspects are fundamental for sustainable development and the well-being of people in the workplace. Within labor law, the nullity of a collective contract has causes and effects, since the invalidity cannot be legally concluded without the consent of the contracting parties, but it can be for legal reasons that are stipulated in the Labor Code and the Civil Code. We will analyze its structure and form that it encompasses in order to guarantee the rights that workers or employees have as well as their benefits that correspond by law. The main objective is to understand the relevance and effectiveness of this legal instrument in the protection of workers' rights and in the promotion of fair and equitable working conditions. The work begins with a historical review of the development of collective contracts in Ecuador, highlighting significant milestones and legislative changes that have influenced its current configuration, the relevant labor laws are examined, as well as international treaties that have contributed to the formation and evolution of this type of contracts in the country. The work also examines practical cases of the application of collective contracts in different Ecuadorian industries, evaluating their impact both in terms of improving working conditions and possible challenges and controversies that arise in their implementation.
